Abstract

The rapid proliferation of digital surveillance technology has fundamentally altered the landscape of criminal adjudication in Pakistan (Ahmad, 2021). While electronic recordings offer an objective record of events, integrating digital evidence into traditional adversarial trials presents complex statutory and evidentiary challenges (Akram, 2020). This research article critically examines the legal framework governing video evidence under Pakistani criminal law, focusing on:

  • The 2023 legislative amendments to Article 164 of the Qanun-e-Shahadat Order 1984 (QSO) (Hassan, 2023).
  • The procedural interaction between the Electronic Transactions Ordinance 2002 (ETO) and the Code of Criminal Procedure 1898 (Cr.P.C.) (Malik, 2021; Mahmood, 2023).
  • The judicial application of the "Silent Witness" theory (Aslam, 2022).

Through a comparative analysis of Pakistani, English, and American jurisprudence, this study explores the tension between ocular testimony, scientific forensic limitations, and judicial visual evaluation ("trier-of-fact comparison") (Ali, 2019; Bhatti, 2023; Parish and Anor v. R, 2021). The article addresses the non-delegable nature of local inspections under Section 539B Cr.P.C. and the appellate powers available under Section 428 Cr.P.C. to cure trial court omissions (Khan, 2020; Mehmood, 2024). Finally, the study outlines strategic structural recommendations to enhance domestic forensic capacity, establish uniform judicial guidelines, and ensure that scientific evidence preserves the constitutional right to a fair trial (National Judicial Policy Making Committee, 2022; Punjab Forensic Science Authority, 2023).
